If you have been ordered to surrender firearms by the court, please contact the Civil Process Coordinator at 715-839-5160 to schedule an appointment. Firearm surrenders are scheduled Monday - Friday, between 8:00 am - 4:00 pm. 

**Do NOT bring firearms into the building without a deputy present**

At the appointed time, a deputy will meet you in the Law Enforcement Center lobby (Oxford Ave entrance - door C1W) and assist you with retrieving the firearms from your vehicle. Firearms must be unloaded and have magazines removed. You will be provided a receipt which must be delivered to the Clerk of Courts office.

A civil standby is done for court orders or as a one-time courtesy following domestic violence incidents for the purpose of retrieving a limited number of belongings or personal effects for the individual removed from the residence. The standby must be completed in 20 minutes or less and can be requested by contacting the non-emergency number at 715-839-4972.

A standby lasting greater than 20 minutes can be scheduled weekdays, between 8:00 am - 3:00 pm, with the Civil Process unit.  A fee is charged (two deputies/two-hour minimum & mileage) and pre-payment is required. To schedule, contact the Civil Process Coordinator at 715-839-5160.

Restraining orders may obtained by filing a petition with the courts. This petition contains information relating to the specific request as well as the reasons why the petitioner is asking for a restraining order. The petition is reviewed by a court commissioner or judge who makes the decision to grant it. If granted, the court clerk will assign a date for an injunction hearing and deliver the documents to the Sheriff's Office for service (unless a private process server is requested by the petitioner). The restraining order has specific requirements, which may include no contact between the petitioner and respondent and may require the respondent to be removed from the shared residence. The four types of restraining orders are:

• Domestic Abuse (WI Stat 813.12 & 813.128) - no service fee
• Harassment (WI Stat 813.125) - $100 service fee may apply
• Child Abuse (WI Stat 813.122) - no service fee
• Individual at Risk (Wi Stat 813.123) - no service fee

A Writ of Restitution orders the Sheriff or his designee to remove the defendant and all individuals claiming residence under the defendant, from a premises in order to return possession to the rightful owner. The Writ is valid for 30 days after the date of issuance and must be completed within 10 days of receipt by the Sheriff's Office.

A deputy will serve the writ along with an eviction notice, specifying the date and time for the lock change. If the defendant is not home, the notice and writ will be posted on the door. If the property is still occupied at the scheduled time, the deputy will remove the person(s) and the personal property left by the defendant will be handled according to the Property memo filled out by the plaintiff.

A Writ of Replevin is an action to regain personal property unlawfully held or retained by another. It is valid for 60 days after the date of issuance.  A Replevin must contain a description of the property and any identifying numbers. Vehicles, including recreational, must have an accurate VIN number.

A bond in the amount of two times the judgement is required. It is the plaintiff's responsibility to locate the property and provide instructions on how and where to return the property (ie, tow company, mover etc). We will not transport the property. If the property is being held in a building or fenced area, the plaintiff is required to obtain a warrant.

A Writ of Assistance is an order of the court requiring the Sheriff or his designee to immediately remove the defendant from the premises as described in the writ and return possession of the premises to the plaintiff. It is often used to assist the purchaser of, or owner of real estate to regain possession, but it can also be used to regain possession of personal property. A Writ of Assistance is valid for 60 days after issuance and may be issued by the courts any time after the Confirmation of Sale hearing.

A Writ of Execution Against Property is an order for the Sheriff to satisfy the demand of a plaintiff, with costs and expenses, by seizing property of the defendant. The writ is valid for 60 days after the date of issuance and requires the following: 1) a bond for three times the amount of the judgement 2) a list of property 3) warrant (if needed) and 4) prepayment of estimated fee. Writs of execution can be quite involved, and fees are determined on a case-by-case basis. Fees may include towing, moving, storage, Sheriff's Sale, and deputy wages.
