Filing for Divorce

All instructions contained herein refer specifically to Eau Claire County only.

The procedures for filing for divorce vs. filing for a legal separation are the same in the State of Wisconsin.  If you wish to file for an annulment, guidance can be found here

Personal Service Requirement: 
A Summons and Petition for Divorce/Legal Separation must be personally served on the other party within 90 days of filing.  See Personal Service instructions for further information.  Proof of service must then be filed with the Clerk of Court Office to proceed with the case.

Waiver of Appearance: 
If parties have filed all required paperwork in a divorce action, and have set a final hearing, one party may be allowed to waive their appearance at the final hearing by completing and filing the following form:  Waiver of Appearance.
