ACKNOWLEDGEMENT OF MEDIATION

I understand I have been ordered to mediation, but I am not mandated to agree to anything. I will never be pressured to come to an agreement by the court, mediator, or the person in mediation with me.

I understand that the mediator assigned to my case will serve as a neutral person to help resolve the dispute.  The mediator will not act as an attorney or advocate for any party.  The mediator does not have the power to impose or enforce the terms of the agreement on any party. 

I understand that the mediation session is strictly confidential.  No party shall be bound by anything said or done in mediation unless a settlement is reached.  If a settlement is reached, the agreement shall be reduced to writing and, when signed, shall be binding upon all parties to the agreement.  I agree not to request that the mediator testify at a deposition or in court. I also agree not to testify about, nor ask the other party to testify about statements made in mediation. Recording devices are not permitted in mediation. 

I understand that I will be the only person present at my mediation session. Significant others, family members (including children), friends, and attorneys are not permitted to be present with me during the mediation. 

I understand that a party may have an attorney review any agreement reached in mediation and that a party may seek legal advice at any time. I understand that TRY Mediation cannot provide legal advice at any time, neither during a mediation session nor out of mediation. 

I understand that my participation in the joint session of mediation is important and may be challenging at times. If there is a time when I decide to end the session I may leave. I understand that I do not need the mediator’s or other person’s permission to do so. I understand that I can take breaks during the mediation session if I feel the need to do so.
